MasterChef eCode – End User Terms and Conditions

These Terms and Conditions apply to Your eCode and its use by You. By using Your eCode You are deemed to accept these Terms and Conditions which shall form a legally binding contract between You and the Purchaser. You must read them carefully.

Your eCode is operated by Us for and on behalf of MasterChef Gift Card. Your eCode is an E-money product and is issued by Us.

The Financial Services Compensation Scheme does not apply to Your eCode. For Your protection, all funds held from time to time on Your eCode are held by Us in trust and safeguarded in accordance with the Electronic Money Regulations 2011. Your eCode does not provide You with any protection under the Consumer Credit Act 1974.

1 Definitions

In these Terms and Conditions, unless the context otherwise requires, the following words and expressions shall have the following meanings:-

1.1 ‘eCode’ means the 14 digit number issued to the Purchaser by PCS which is then gifted to You to be used to purchase Goods from Artisan Retailers at www.masterchefgiftcard.co.uk;

1.2 ‘E-money’ means electronic money as defined in the Financial Conduct Authority Handbook of rules and guidance;

1.3 ‘Goods’ means goods and/or services which are available from a Retailer via www.masterchefgiftcard.co.uk and can be paid for using eCodes. Some Retailers may not accept Your eCode to pay for certain goods, including, but not limited to, their own vouchers or gift cards or the payment of a credit account;

1.4 ‘MasterChef Gift Card’ means CKG Gift Cards Limited (trading as MasterChef Gift Card) (Company Registration No. 10457948), whose registered office is at The Bramblings, Hollins Lane, Forton, Preston, PR3 0AB;

1.5 ‘PCS’/‘We’/‘Us’/’Our’ means Park Card Services Limited (Company Registration No. 3280082), the E-money issuer, whose registered office is at Valley Road, Birkenhead, Merseyside CH41 7ED;

1.6 ‘Purchaser’ means the person who paid for the eCode;

1.7 ‘Retailer’ means those artisan retailers who have from time to time agreed with MasterChef Gift Card to accept Your eCode in payment for Goods;

1.8 ‘Shine TV’ means Shine TV Limited (Company Registration No. 06978553) whose registered office is at c/o Endemol UK Ltd Legal Department, Shepherds Building Central, Charecroft Way, London, W14 0EE, together with its parent, associated and affiliated companies; and

1.9 ‘You’/’Your’ means the person to whom the eCode has been gifted to by the Purchaser as part of its incentive/reward scheme or such other permitted user of the eCode from time to time.

2 Your eCode

2.1 The eCode is issued to the Purchaser. We will assume, unless and until we are notified to the contrary, that the person who uses the eCode at any time is the rightful user of the eCode.

2.2 The eCode -

2.2.1 cannot be exchanged for cash and no exchange can be given by Us; and

2.2.2 can only be used to purchase Goods from Retailers online at www.masterchefgiftcard.co.uk.

2.3 The eCode is denominated in GBP (£s).

2.4 You will not earn any interest on any funds loaded onto the eCode nor receive any other benefit related to the length of time you hold the eCode.

2.5 We will not issue a statement in respect of your eCode but details of how the balance of Your eCode can be obtained are set out in clause 3.1.

2.6 Unused balances are not transferable.

2.7 Both You and the Purchaser must be over the age of 18 and resident in the United Kingdom or the Channel Islands.

3 Lost, Stolen, Damaged or Destroyed eCodes

3.1 If You lose Your eCode or it is stolen or misappropriated, or You suspect that Your eCode has been used by an unauthorised person, or Your eCode malfunctions or is damaged or destroyed or a transaction is incorrectly executed You must notify Us without undue delay by telephoning Our 24/7 automated telephone service on 0344 770 9015 and quoting Your eCode number.

3.2 Upon receipt of Your eCode number in accordance with clause 3.1, We will, at Our sole election, either suspend or cancel Your eCode as soon as reasonably possible.

3.3 You are liable for all losses in respect of an unauthorised payment transaction where You have acted fraudulently or You have with intent or gross negligence failed to notify Us without undue delay on becoming aware of the loss, theft, misappropriation or unauthorised use of Your eCode. You are liable for a maximum of £35 for any losses incurred in respect of any unauthorised payment transactions arising from the further use of Your eCode after You notify Us of the loss, theft, misappropriation or unauthorised use of Your eCode, in accordance with clause 3.1.

3.4 After such security checks as We may require, We will, unless We believe that fraud may be involved, and subject to clauses 3.1 and 3.3, at Our complete discretion either arrange for a replacement eCode to the value of the balance on Your eCode at the time it is reported lost, stolen, damaged or destroyed, and subject to clause 3.3, to be issued to You, or refund such balance to You. If We refund the balance, We will do so in accordance with clause 10.

3.5 Valid claims will be completed within 10 working days and if a replacement eCode is issued We may (at Our complete discretion) charge You a fee of £8.90.

4 Charges

All charges referred to in these Terms and Conditions will be automatically deducted from the balance on your eCode.

5 Expiry of the eCode

Your eCode will expire on the date set out in the email notifying you of the eCode number following which it will no longer be valid and neither You nor any other person will be able to use the eCode.

6 Redemption

The eCode has been given to you. You have no right of redemption nor any right to require the Purchaser to exercise a right of redemption prior to its expiry.

7 Complaints

7.1 If You have a complaint concerning Your eCode or Our service then in the first instance please contact MasterChef Gift Card on 01524 805034 between 9am and 5pm Monday to Friday or thereafter Card Services.

7.2 All complaints will be dealt with as quickly and as fairly as possible in accordance with Our complaints procedure, details of which can be obtained by telephoning Card Services.

7.3 If We are unable to resolve Your complaint, You may contact the Financial Ombudsman Service at Exchange Tower, London E14 9SR or by telephone on 0800 023 4567 (calls to this number are now free on mobile phones and landlines) or on 0300 123 9 123 (calls to this number are now charged at the same rate as 01 or 02 numbers). These numbers may not be available from outside the UK, so please call +44 20 7964 0500 if You are phoning from abroad. You may also email: enquiries@financial-ombudsman.org.uk.

8 Data Protection

Both We and MasterChef are committed to maintaining all data which is collected or processed in accordance with all applicable data protection legislation and both will take reasonable steps to ensure that all information concerning You or Your eCode is kept secure against unauthorised access, loss, disclosure or destruction.

9 Use of the eCode

9.1 Full instructions on how the eCode is used can be found on the personalised email(s) you have received.

9.2 You must:-

9.2.1 treat the eCode as if it were cash;

9.2.2 take all reasonable precautions to ensure that the eCode is not lost, stolen, damaged or destroyed eCode;

9.2.3 let Us know without undue delay if your eCode is lost, stolen, damaged or destroyed.

9.2.4 Keep the email which contains the eCode safe.

9.3 The eCode can only be used to purchase Goods from Retailers online at www.masterchefgiftcard.co.uk.

9.4 We will debit the amount of all purchases of Goods from the balance on your eCode immediately the purchase is completed.

9.5 If we need to investigate a transaction on the eCode then You must co-operate with Us, the police or any other authorised body if this is reasonably required.

9.6 The maximum amount You can spend is the amount of the eCode. If You attempt to spend more than the balance the transaction will be declined.

9.7 The eCode must not be sold by You, or by any other holder of the eCode from time to time, but it may be gifted by You to any person to use to pay for Goods. If you gift an eCode to another person You will be responsible for all use of the eCode and You must ensure that such person understands and complies with the obligations contained in these Terms and Conditions, particularly those relating to the security and use of the eCode.

10 Disputes with Retailers

10.1 For the avoidance of doubt, We and MasterChef Gift Card will not be liable for any Goods supplied by Retailers and paid for with Your eCode. Any queries or complaints concerning such Goods must be addressed to the relevant Retailer. Your eCode does not provide You with any protection under the Consumer Credit Act 1974.

10.2 Once You have used Your eCode to make a purchase We cannot stop such purchase and the amount of that purchase will be debited to Your eCode immediately when the purchase is completed.

10.3 Each Retailer will have its own return policy and this is listed on their individual retailer webpage when redeeming your eCode, and they will handle Your returns in accordance with that policy. If a Retailer becomes liable to make a refund to You, the Retailer cannot credit the amount of such a refund to Your eCode; refunds are between You and the Retailer.

10.4 If at any time You believe that a purchase has been incorrectly debited to Your eCode You must let Us know without undue delay by contacting Card Services. We will make all reasonable endeavours to resolve Your query as soon as possible so that Your eCode may be restored to the state it would have been had a defective payment transaction not taken place. If Your query is in Our reasonable opinion unfounded then We reserve the right to charge an administration fee of £10.00. Refunds may only apply after an appropriate investigation of an incorrectly debited purchase. You must provide such information as is reasonably necessary to ascertain whether a refund is appropriate.

10.5 If Your eCode is refused a Retailer may explain the reason why to You or You may ring MasterChef Gift Card or Card Services to obtain an explanation.

11 Regulation and Protection

11.1 We are authorised and regulated by the Financial Conduct Authority (firm registration number 900016) to carry on the regulated activity of issuing E-money.

11.2 Although the E-money product is regulated by the Financial Conduct Authority, it is not covered by the Financial Services Compensation Scheme. No other compensation scheme exists to cover losses claimed in connection with eCodes. This means that in the event that We become insolvent, any E-money on Your eCode may become valueless and unusable and may be lost. For the protection of eCode-holders, all funds held from time to time on eCodes are held by Us on trust in accordance with the terms of the Park Card Services Ltd E-Money Trust.

11.3 To comply with money laundering regulations, We may require proof of Your identity and address, prior to activating any eCodes purchased. We will seek to obtain these electronically as a consequence of which:-

11.3.1 the search may be carried out by a third party;

11.3.2 the third party may check Your details against a database (public or otherwise) to which they have access;

11.3.3 a record of the search may be retained and passed onto other parties for the purposes of anti-money laundering.

12 Our Liability

12.1 We cannot guarantee that a Retailer will accept Your eCode. The reasons for any non-acceptance or non-authorisation could be beyond Our reasonable control, for example a system failure or a concern by the Retailer that Your eCode is being mis-used.

12.2 If a Retailer is unwilling or unable to accept Your eCode in payment for any Goods You should contact MasterChef Gift Card on 01524 805034 between the hours of 9am and 5pm Monday to Friday.

12.3 We and MasterChef Gift Card shall not be liable to You for any loss or damage You may suffer in the event a Retailer refuses to accept Your eCode.

13 Rights of Third Parties

These Terms and Conditions do not create any right enforceable by any person who is not a party to them, except that:-

13.1 these Terms and Conditions may be enforced by Us;

13.2 a person who is the permitted successor or assignee of the rights of a party referred to in these Terms and Conditions is deemed to be a party to these Terms and Conditions and the rights and obligations of such successor or assignee shall, subject to and upon any succession or assignment permitted by these Terms and Conditions, be regulated by these Terms and Conditions.

14 Governing Law and Jurisdiction

These Terms and Conditions shall be governed in accordance with English Law and the parties hereby submit to the exclusive jurisdiction of the English courts. All communications regarding any aspect of these Terms and Conditions shall be in English. You can request a copy of this Agreement during its term.

15 Variation

15.1 We may vary these Terms and Conditions as and when We require (including, without limitation, changing existing fees or introducing new fees), provided that We have given You not less than 2 months prior notice of any such variation, unless a change in the law does not allow Us to provide You with 2 months prior notice.

15.2 When We notify You of a change to these Terms and Conditions, You will be deemed to have accepted the notified change unless You notify Us that You do not agree to the change prior to the change taking effect. In such circumstance, We will treat Your notice to Us as notification that You wish to terminate these Terms and Conditions immediately and We will refund to You the remaining balance on Your eCode before any variation is applied in accordance with Clause 8 above (save that no redemption fee will be payable).

15.3 Notification of any changes will be provided to You by email, by post, via Our and/or MasterChef Gift Card’s website, and/or by other agreed means and You agree that this is an appropriate method to vary these Terms and Conditions.

16 Licence Agreement

We have entered into a licence agreement with Shine TV, which owns and produces the MasterChef television series broadcast on the BBC. Neither Shine TV nor the BBC operate or control any part of the MasterChef Gift Card Website (www.masterchefgiftcard.co.uk) and we are fully responsible for the operation and content of this website. Any reference to any product or supplier on this website should not be construed as an endorsement or approval by Shine TV, the BBC and/or the MasterChef television series.
